🔑 Key Lessons for Employers from the Employment Court judgment in Soapi & Others v Pick Hawke's Bay Inc [2025] NZEmpC 208

1. đź’° Deductions Must Be Lawful and Transparent


Written consent is essential: Deductions from wages must be authorized by the employee in writing and must comply with the Wages Protection Act 1983.


Submit deductions to INZ: All deductions must be disclosed and approved during the ATR (Agreement to Recruit) process with Immigration New Zealand.


Avoid hidden or unclear practices: The Court criticized Pick Hawke’s Bay for not explaining how deductions (e.g., reducing balance repayments) worked in practice


2. 🏡 Accommodation Charges Must Be Fair


Cost recovery must reflect actual use: Charging seasonal workers based on annualized accommodation costs (including months they weren’t housed) was deemed inappropriate.


Disclose related-party arrangements: If accommodation providers are affiliated with the employer, this must be transparently disclosed to INZ and employees



3. 🩺 Pastoral Care Obligations Are Binding


Employers must provide adequate housing, health services, and support as part of their RSE obligations.


Facilities must meet reasonable standards - the Court noted overcrowded and poorly equipped housing as problematic



4. 🦺 Protective Equipment Must Be Provided Free


Deductions for personal protective equipment (PPE) violated the Health and Safety at Work Act 2015.


Employers must supply PPE at no cost and cannot treat it as a recoverable expense



5. 🤝 Employment Agreements Must Be Clear and Accessible


Agreements should be in a language the employee understands.


Avoid requiring employees to sign multiple versions of contracts without clear explanation



6. 🛬 Avoid Pre-Employment Deductions


Deductions for costs incurred before employment begins (e.g., travel, visa fees) must be carefully reviewed for legality and fairness



7. 🛂 Finally - Avoid Coercive Practices (e.g., passport retention)


Avoid curfews or rules that interfere with personal dignity or family life.
